TERMS AND CONDITIONS SPECIFIC TO THE CONTRACT

1.- The present rental agreement will be governed according to the data and object established in the heading and according to the current rate system published in www.alicantebikes.com.

2.- The bicycles will be collected and will be returned at the rental place, in our shop, at the times, rates and conditions specified in this contract. Failure to comply with the delivery time will result in an additional charge to the customer of 5 euros per hour or fraction of delay. If delivery is not made on the day stipulated in the contract, the additional charge will be 30 euros per day. By not making the return, the rental company may take immediate possession of the bicycle in the place where it is, and execute the legal actions it deems appropriate.

3. The full day time slot from 09:00 a.m. to 8:00 p.m. For longer rentals the client can keep custody of the bicycle if it´s kept in a safe place.

4. The bicycle (s) and the additional material that is delivered, will be returned completely and in the same state in which it was delivered to the customer. The cost for repair or replacement of the bicycle and / or material, in any case will be borne by the renter. The client must inform the rental company of the damages caused in said material or of the malfunction thereof. The customer is obliged to take good care and take all necessary precautions to protect the bicycles and equipment rented from damage, loss or theft. If any of the aforementioned situations occur during the rental period, the client will immediately assume all replacement costs incurred at the market price. At the end of the rental period, the rental company will determine the conditions of delivery of the rented material and, if necessary, assess the losses or damages caused. The customer is obliged when the bicycle (s) is not in sight to fix and secure it (s) correctly with the padlock supplied.

5.- .- The renter declares to be in good physical condition and health, and be able to drive a bicycle and have the necessary control of the rented equipment.

6.- The contract includes technical assistance for mechanical failures within a maximum of 10 kilometers radius form our store. If the failure occurs more than 10 kilometers away, a charge for this service of 20 euros plus 0.5 euros per kilometer would apply.

7.- In this act the renter delivers a deposit of € 200 for the rental of a bicycle or € 150 for a bicycle if there are two or more, this payment will be made by credit card or in cash and will serve to answer for the possible damages caused to the bicycle or the rented equipment, this deposit will be reimbursed at the end of the contract, as long as there is conformity in the returned material. In case of loss or theft, the renter must assume the total cost of the bicycle according to the market price. In no case can the bail serve for an extension or extension of the contract.

8.- It is the responsibility of the renter and his / her companion (s) to know and respect the Spanish traffic rules and to drive the bicycle in accordance with the basic rules of driving and prudent circulation. Taking charge and responsible for any traffic infraction that could be incurred.

10.- .- No reimbursement for returns made before the time stipulated in the contract.

11.- The rental of bicycles for the use of minors must always be supervised and authorized by their parents or guardians, who under this contract give their consent and exempt the rental company from any responsibility with respect to the minor.

12.- .- The data provided by the client, will be used exclusively for the correct provision of the contracted service, being able to request, in accordance with the LOPD law, access, rectification, cancellation or opposition by communication by any means to the renter. This contract is governed by Spanish law.
